Georgescu Gonț obtains Termination of Dan Șova’s Criminal Trial at the ICCJ on the Grounds of Statute of Limitations

Dan Șova had been accused by the National Anti-Corruption Directorate (DNA) of receiving €100,000 between 2011 and 2014 to arrange legal assistance contracts worth €10,000 per month for CET Govora, thereby causing damages of over 1.3 million lei. Dan Șova never admitted to the charges against him, always claiming that the evidence did not support the prosecutors’ allegations.

In March 2023, Sova was finally sentenced to three years in prison for influence peddling, although his lawyers argued that the statute of limitations had expired.

In yesterday’s decision, the High Court of Cassation and Justice (ICCJ) confirmed this, ruling that the statute of limitations for criminal liability for the offense of influence peddling had already expired at the time of the 2023 conviction.

Consequently, the criminal proceedings were terminated and all forms of enforcement issued against Dan Șova were canceled.

“This solution for our client Dan Șova is grounded in our rigurous defense strategy before the court of appeal even from since the trial phase. Our experience with similar cases allowed us to see the opportunity to file an extraordinary appeal in cassation, in which we invoked an exception of unconstitutionality that paved the way for the termination of the criminal proceedings,” said Adrian Georgescu.
